This Privacy Policy ("Notice") sets out the basis on which GM Gifts Limited Company (trading as Gift Market Vietnam, "we", "us", or "our") collects, uses, discloses and processes personal data of our customers, website visitors, and corporate contacts in accordance with Vietnamese e-commerce regulations (Decree 52/2013/ND-CP, amended by Decree 85/2021/ND-CP) and the Personal Data Protection Regulation (Decree 13/2023/ND-CP).

1. Purposes of Personal Data Collection

We collect personal information to provide B2B corporate gifting services. The specific purposes include:

  • Responding to and processing your product enquiries, quotes, mockups, and orders.
  • Performing B2B commercial contracts and delivering products to physical destinations.
  • Handling post-sale support, warranty requests, replacement logistics, and quality issues.
  • Sending corporate newsletters, product catalogues, and seasonal holiday gift advice (with user opt-in/opt-out choice).
  • Complying with mandatory Vietnamese tax declarations, corporate financial audits, and legal requests.

2. Scope of Collected Personal Data

Depending on your interaction, we may collect the following personal information:

  • Full Name of the contact person (Họ và tên).
  • Corporate email address (Email công ty).
  • Telephone number or Zalo number (Số điện thoại / Zalo).
  • Delivery address (Địa chỉ giao hàng) and Billing address.
  • Company profile details (Tax code, representative role) and transaction notes.

3. Scope of Personal Data Use & Disclosure

We strictly use your personal data within the boundaries of B2B client relation operations. We do not sell, rent, or trade personal data to third parties. We will only disclose personal data to:

  • Our staff members directly handling your enquiry, graphic design mockups, and order execution.
  • Authorized logistics and shipping service providers solely to perform product deliveries.
  • Competent state authorities (Tax department, inspectors) when strictly required by Vietnamese commercial laws.

4. Storage Duration

Your personal information is securely stored inside our database systems. Data will be retained for as long as is reasonably necessary to fulfill the operational business goals and legal obligations (such as accounting or tax record retention rules). Personal data will be deleted or anonymized immediately if the customer requests deletion, or when the legal storage requirements expire.

5. Methods for Users to Access, Rectify, or Delete Data

Under Decree 13/2023/ND-CP, customers have full control over their personal data. You have the right to access, request corrections, restrict processing, object to marketing use, or request total deletion of your personal data stored by us.

7. Customer Complaint Resolution Mechanism

  1. Submit a written report detailing the incident to dpo@giftmarket.com.vn.
  2. We will acknowledge receipt within 24 hours and investigate the claim.
  3. Within 7 to 15 working days, we will provide a written report detailing our findings, security logs, and the corrective actions taken.
  4. If the dispute cannot be resolved directly, both parties have the right to escalate the matter to the Cybersecurity Department (A05) of Vietnam.
